Costs & Fees in Chapter 13 Bankruptcy

One of the most common questions our clients ask our bankruptcy attorneys is how much filing Chapter 13 bankruptcy will cost. Our bankruptcy attorneys are committed to being open and “up front” about your bankruptcy costs – and we are dedicated to keeping your fees as low as possible.

Michigan Court Costs in Chapter 13 Bankruptcy

Certain “filing fees” must be paid to the Bankruptcy Court. These costs are separate from your bankruptcy lawyer’s fees. In Michigan the Court Fees to file Chapter 13 Bankruptcy are as follows.

The Filing Fee to File a Chapter 13 Bankruptcy is $310. This ncludes miscellaneous administrative fee of $75.00.

Note that bankruptcy filing fees are current as of the date of publication, but are subject to change in the future.

Every Bankruptcy Case Is Different

Attorneys will generally base your fees upon the degree of complexity in your Chapter 13 case. A bankruptcy with many creditors may take more time – and therefore have slightly higher attorney fees – than a case with only a few creditors.

Our bankruptcy attorneys are committed to keeping your attorney fees as low as possible in your Chapter 13 Bankruptcy. Call us today for a free consultation, and our experienced attorneys can give you an exact price that is based upon the individual facts of your Chapter 13 Bankruptcy.

Judges Can Examine Attorney Fees in a Bankruptcy

Attorneys who file Chapter 13 must disclose their attorney fees to the Judge for review and approval. If the Judge finds that the attorney fees charged are excessive or “not reasonable”, the Judge can order an attorney to refund all or a portion of the fee.

Beware of Extremely Low Advertised Bankruptcy Fees

If you TV commercials or ads in the newspaper that promise unbelievably low attorney fees in a Chapter 13 case, beware. Many times these “low low” priced ads are deceptive – and then these “low ball” attorneys increase the advertised fees by adding on hidden or additional fees!

Paying Chapter 13 Attorney Fees through the Plan

In Chapter 7 cases court fees and attorney fees are typically paid before the case is filed. But in a Chapter 13 Bankruptcy the court fees and attorney fees are often paid – at least in art – as part of the repayment plan.
